I Have started to read this New North Tyneside Policy as of Wednesday 8th April 2009 that was passed at the Regulation and Review Committee that sat at 6pm in Room 001(Council Chamber)The Quadrant, Silverlink.

It was approved under Conditions 4.3.1
The Council has the power to impose such conditions on an operator`s licence as it considers reasonably neccessary.

I now point out Section 4.1 Requirements and Obligations and condition 4.1.4

A private hire operator must ensure that every private hire vehicle despatched by him is licensed and driven by a person who holds a private hire drivers licence. All three licences(operator,vehicle and driver) must be issed by the same licensing authority.

Condition 4.1.4 now that North Tyneside Councillors have approved as of 8th April 2009 this Policy meaning they can legally apply the spirit of the law, as it was morally intended, in relation to banning out of town hackney carriage vehicles from being used under a North Tyneside Private Hire Operator Licence as a reasonably necessary CONDITION OF LICENCE POLICY.

How long will we have to wait for Newcastle and the other Authorities to follow suit and for North Tyneside Licensing Officers to start to revoke any North Tyneside private hire operator proprietors licence, who fails to comply with the New Policy Rules?

Please feel free to read the Policy, if you do not believe I have stated what is written in the New Policy for yourself!!!!!!

@thelighthousekeeper,The key words are “every private hire vehicle” Berwick Licences are Hackney Carriages! Even when operating as a private hire they are still Hackney Carriages! The policy should have read: “A private hire operator must ensure that every vehicle that operates as a private hire and despatched by him is licensed and driven by a person who holds a private hire drivers licence. All three licences(operator,vehicle and driver) must be issed by the same licensing authority..”

@Admin, The fact that North Tyneside Council have put ALL THREE LICENCES MUST BE ISSUED BY THE SAME LICENSING AUTHORITY will be seen in a court of law as a reasonable condition to be applied to all North Tyneside Private Hire Operator Licences & any Proprietor not complying will be seen as “not fit and proper” one would hope.

The Judge in the Berwick Case stated the spirit of the law was not being applied by these out of town Hackney Carriages and the Judge said go away and come up with a solution and this is clearly North Tyneside Councils solution that should be enforced!

Surely you must see that!!!!

@thelighthousekeeper, I understand what you are saying. When I asked NTC about this, the answer that was given was that Berwick are Hackney Carriages and therefore do not apply to a policy about Private Hire.
